DEFINITION

CIMB Clicks
Clicks Shoppe (the “Website”) is a service that is offered at 
www.cimbclicks.com.my (“CIMB Clicks”), a website owned by CIMB Bank 
Berhad (“CIMB”). 

Buyer and Products
This Website offered enables you (the “Buyer”) to make online purchases 
of displayed goods and services (hereinafter referred to as 
“Product(s)”). The Buyer who is CIMB Clicks registered user or FPX 
Online Payment Service user is eligible to make Products purchase 
transaction in this Website.

Merchants
CIMB Clicks merely provides the Website in which selected merchants 
recruited by CIMB Clicks (hereinafter referred to as “Merchants”) may 
make their Products available in this Website. Your actual purchase of 
the Products will be subject to the Merchant’s standard terms and 
conditions of sale and any other specific terms and conditions of sale 
as may be applicable to the particular Products. All agreements 
pertaining to the sale and purchase of Products via this Website shall 
therefore be subject to an agreement between you and the respective 
Merchants.


GENERAL

1. The following terms and conditions govern your use and access to this
 Website. By using this Website to perform any Products purchase 
transaction/s, you are indicating your acceptance of the following terms
 and conditions outlined below (the “Terms and Conditions”). If you do 
not accept or are not agreeable to any of the Terms and Conditions set 
our herein, you are advised to immediately discontinue use or access to 
this Website.

2. The information, content or Terms and Conditions in this Website may 
be changed from time to time with or without notice at CIMB Clicks 
absolute discretion. As such, your continued use or access to this 
Website and/or any other services provided herein subsequent to any such
 change will be deemed as your acceptance to those changes. 



PAYMENT METHOD

The Buyer can choose to pay the total amount of Products purchase/s 
including courier charges in this Website on the following payment 
options:

a) CIMB Clicks – The Buyer must be a successful registered CIMB Clicks 
users and  all payment made through CIMB Clicks is subject to CIMB 
Clicks terms and conditions;

b) FPX Online Payment Service – The Buyer must have internet banking 
account with the FPX participating banks and any payment made through 
FPX Online Payment Service is subject to terms and conditions of FPX 
Payment Gateway Sdn. Bhd.



DELIVERY POLICY

1. All the Products purchase made by the Buyer will be covered by the 
Merchant’s normal delivery terms of business. Except where the law 
provides otherwise, CIMB Clicks will not responsible for the quality or 
suitability of the Products or any delay in delivery.

2. Claims of non-receipt of Products will not be entertained after one 
(6) month from the date of online purchase.

3. No delivery of Products will be made to a P.O.Box address.

4. Delivery of Products will only be made against written 
acknowledgement of receipt of Products by occupant at the residential 
address for delivery and where such address is an office address, by any
 member of the office. Such acknowledgement shall be deemed to be 
acknowledgement of the Buyer.

5. The merchants will make arrangement to deliver the Products to the 
Buyer within such time period as stated at the Product Description 
(barring any unforeseen circumstances) subsequent to receipt of the 
Buyer’s confirmation of purchase and payment.

6. For any purchase of Products make on Saturday, Sunday and/or Malaysia
 public holiday, the arrangement of delivery will only be made on the 
next working day.

7. The delivery of the Product within the time period for delivery shall
 be the sole responsibility of the Merchant and CIMB cannot be held 
liable for any delay or failure to deliver the Product.



RETURN AND REFUND POLICY

1. CIMB shall handle all requests for the return of the Products via its
 customer service email at the “Contact Us” section. In addition all 
queries, comments and complaints in relation to the Website and the 
Products made available at the Website may also be made via email and 
CIMB will channel the complaint to the respective Merchants.

2. Requests for return of Products can only be made within fourteen (14)
 days from the date of receipt of the Products based on the Merchant’s 
record, and only where the Products delivered are damaged or defective 
upon delivery or do not correspond with the order made.

3. Return of the Products shall be subjected to additional charges in 
circumstances where the Products’ failure to correspond with the order 
made by the Buyer is due to the Buyer' failure to provide accurate or 
complete instructions when placing the order through the Website.

4. All return of Products request is subject to the respective 
Merchant’s approval and for the avoidance of doubt, no cancellation of 
order or exchange of Products for another item or similar or different 
value shall be allowed.

5. The return of the Products shall be made to the respective Merchants 
in securely packaged and wrapped conditions and the delivery cost for 
the return of Products shall be borne by the Buyer.

6. All returned Products shall be exchanged with Products of the same 
description as stated in the “Confirmation Order” page. A refund in 
relation to returned Products will only be made if the Merchants do not 
have sufficient stock of the returned Products.



LICENSE AND WEBSITE ACCESS

1. Unless otherwise stated, CIMB own the intellectual property rights in
 the Website and any other materials on the Website. 

2. The Buyer may view, download for caching purposes only and print 
pages from the Website for the Buyer’s placement of order for the 
Product, subject to the restrictions set out in this Terms and 
Conditions.

3. The Buyer must not:

a) Republish any material(s) from the Website (including republication 
on another website);

b) Sell, rent or sub-license material(s) from the Website;

c) Show any material(s) from the Website in public;

d) Reproduce duplicate, copy or otherwise exploit material(s) on the 
Website for commercial purposes;

e) Edit or otherwise modify any material(s) on the Website; or

f) Redistribute material(s) from the Website [Except for content(s) 
specifically and expressly made available for redistribution such as 
newsletter]. 



DISCLAIMER OF WARRANTIES AND LIABILITY

1. The materials and information in  this  Website, including but not 
limited to the Products description, information, data, text, image, 
audio, video, links or other items (hereinafter collectively referred to
 as “Materials and Information”) are provided on an “as is” and “as 
available” basis.

2. CIMB shall use its reasonable efforts to ensure the accuracy and 
validity of the Materials and Information made available in the Website.
 CIMB  does not make any warranty, express or implied representations or
 endorsements including but not limited to any warranties of title, 
merchantability, usefulness, completeness, accuracy, satisfactory 
quality, reliability, fitness for particular purpose of the Materials 
and Information and/or functions on Products made available on the 
Website.

3. CIMB shall not in any event be liable for any loss or damage 
howsoever arising whether in contract, tort, negligence, strict 
liability or any other basis, including without limitation, direct or 
indirect, special, incidental, consequential or punitive damages or loss
  of profits or savings arising in connection with your access or use or
 the inability to access or use the Website (or any third party link to 
or from the Website), reliance on the information contained on the 
Website, any technical, hardware or software failure of any kind, the 
interruption, error, omission, delay in operation, computer viruses, or 
otherwise. This exclusion clause shall take effect to the fullest extent
 permitted by law.



CONDUCT

The access to and use of the Website shall at all times be in accordance
 with all rules, regulations, laws and legislation governing the same 
and any guidelines and policies of CIMB Clicks pertaining thereto. You 
shall not conduct yourself in a way which:

a) Disrupts the access and use of the Website and the Products provided 
hereunder by others;

b) Disrupts the provision of the Website and the Products by CIMB Clicks
 and the Merchants;

c) Adversely affects the rights of CIMB Clicks, the Merchants or any 
other persons;

d) Gives rise to civil liability or constitutes a criminal offence;

e) Is objectionable to public morals and decency or otherwise misuse in 
any way, the Website, its contents and the services provided hereunder. 
Neither shall you assist or enable others to perform or carry out the 
acts as above mentioned.

1. All content included on the Website, such as text, graphics, logos, 
button icons, images, audio clips, digital downloads, data compilations,
 and software, are owned and/or licensed by CIMB Clicks and/or its 
content supplier are protected by copyright, trademarks and other laws. 
The compilation of all content on the Website is the exclusive property 
of CIMB and is protected by copyright laws. 

2. Unless the prior written consent of CIMB and/or the relevant third 
party proprietor(s) of any of the trademarks, service marks or logos 
appearing on the Website have been obtained, no license or right is 
granted to any party accessing the Website to use, download, reproduce, 
copy or modify such trademarks, service marks or logos. Similarly, 
unless the prior written consent of CIMB Clicks and/or the relevant 
proprietor(s) has been obtained, no such trademarks, service marks or 
logos may be used as a link or to mark any link to the Website or any 
other site owned and/or controlled by CIMB Clicks.



INDEMNITY

You hereby irrevocably agree to indemnify and keep indemnified CIMB from
 all liabilities, claims, losses and expenses, including any legal fees 
that may be incurred by CIMB in connection with or arising from:

a) Your misuse of this Website and the services provided herein, and/or;
 

b) Your breach of these Terms and Conditions howsoever occasioned, 
and/or; 

c) Any intellectual property right or proprietary right infringement 
claim made by a third party against CIMB Clicks in connection with your 
use of the Website.



CURRENCY

All transactions in the Website are to be conducted and payable in 
Ringgit Malaysia (MYR), unless otherwise indicated.



WAIVER

The failure of CIMB to exercise or enforce any right or provision of 
these Terms and Conditions shall not constitute a waiver of such right 
or provision.



LAW AND JURISDICTION

These terms and conditions are governed by and are to be construed in 
accordance with the laws of Malaysia. By accessing this Website and/or 
using the services provided herein by CIMB, you hereby consent to the 
exclusive jurisdiction of the courts of Malaysia in all disputes arising
 out of or relating to the use of this Website. CIMB makes no 
representation that the materials, information, functions and/or 
services provided on this Website are appropriate or available for use 
in jurisdictions other than in Malaysia.
